LONDON: A British judge on Tuesday upheld an arrest warrant for WikiLeaks founder Julian Assange but delayed until next week her decision on a further application by his lawyers to cancel it.
"I'm not persuaded that the warrant should be withdrawn," judge Emma Arbuthnot told a court in London, explaining that Assange had breached his bail conditions in 2012.
But she said she would rule separately on another application from Assange's lawyers asking her to consider whether it would be in the "public interest" to keep the warrant in place.
That ruling will be issued on February 13 at 1400 GMT.
Assange entered the embassy in June 2012 to dodge a European arrest warrant and extradition to Sweden over a 2010 probe there into rape and sexual assault allegations.
Sweden dropped its investigation last year, but British police are still seeking to arrest Assange for failing to surrender to a court after violating his bail terms during his unsuccessful battle against extradition.
Assange's lawyer Mark Summers had argued in court last week that the warrant had "lost its purpose and its function".
He said Assange had been living in conditions "akin to imprisonment" and his "psychological health" has deteriorated and was "in serious peril".
"The last five-and-a-half years that he has spent may be thought to be adequate, if not severe punishment, for the actions that he took," Summers said.
The court heard that the 46-year-old was suffering from a bad tooth, a frozen shoulder and depression.
But prosecutor Aaron Watkins earlier called Assange's court bid "absurd".
"The proper approach is that when a discrete, standalone offence of failing to surrender occurs, it always remains open to this court to secure the arrest," he said.
Assange has refused to leave the embassy, claiming he fears being extradited to the United States over WikiLeaks' publication of secret US military documents and diplomatic cables in 2010.
US Attorney General Jeff Sessions last year said his arrest was a "priority".

Assange only very rarely emerges onto the balcony of the embassy building, citing concerns for his personal safety, but he frequently takes part in media conferences and campaigns via video link.
Ecuador in December granted citizenship to the Australian-born Assange, and asked Britain to recognise him as a diplomat, in an unsuccessful attempt to provide him with immunity and usher him out of its embassy without the threat of arrest.
But London swiftly rejected the move.
"Ecuador knows that the way to resolve this issue is for Julian Assange to leave the embassy to face justice," the British government said.
Assange has strained the patience of his hosts during his long stay.
He was publicly reprimanded for interfering in the 2016 US election after publishing emails from the campaign team of Democrat Hillary Clinton.
More recently, he drew the ire of Ecuadoran President Lenin Moreno when he used Twitter to issue messages of support for Catalonia's independence drive.
Moreno was forced to respond to complaints from the Spanish government.
Moreno, in office since 2017, said last month Assange was an "inherited problem" that had created "more than a nuisance" for his government.

Julian Assange has reacted angrily after a British judge upheld an arrest warrant that leaves the WikiLeaks founder still a wanted man in the country where he has spent more than five years inside the Ecuadorian Embassy.
Judge Emma Arbuthnot rejected a call from Mr Assange’s lawyers for the warrant to be revoked because he is no longer wanted for questioning in Sweden over alleged sex crimes.
The UK arrest warrant was issued in 2012 for jumping bail.
“I am not persuaded the warrant should be withdrawn,” Ms Arbuthnot told lawyers, journalists and Assange supporters gathered at London’s Westminster Magistrates’ Court on Wednesday morning (AEDT) .
However, she allowed Mr Assange’s lawyer to make a new set of arguments, and said she would rule on them next week.
In a string of tweets posted following the decision, Mr Assange dismissed “wall to wall fake news stating the government won today’s hearing”.
He added: “Nothing of the sort has happened. The hearing is still happening. Only one point has been ruled on.”
“Judge has ruled against the first technical point the court now expected to hear & decide on the other points,” Assange said in another tweet.
Mr Assange, 46, has been holed up in Ecuador’s embassy in London since he took refuge there in June 2012 to avoid extradition to Sweden.
Swedish prosecutors at the time were investigating allegations of sexual assault and rape made by two women in 2010.
Swedish prosecutors dropped the case last year, saying there was no prospect of bringing Mr Assange to Sweden in the foreseeable future. But Assange was still subject to the British warrant for breaching his bail conditions in 2012.
Ms Arbuthnot said that if Mr Assange wanted the warrant lifted he should surrender to authorities and come to court.
She said he would be able to argue his case and “put an argument for reasonable cause” for breaching his bail conditions.
After the ruling, the judge agreed to let Mr Assange’s lawyer, Mark Summers, argue in his client’s absence that WikiLeaks founder had “at all times” offered to cooperate with the Swedish investigation that the warrant should be lifted because it was no longer in the public interest to arrest him.
Mr Summers said Mr Assange had health problems including depression, and argued that the five and a half years he has spent inside the embassy were more than adequate punishment for his actions.
Ms Arbuthnot said she would rule on those arguments on February 13.
Had the judge ruled in Mr Assange’s favour on Wednesday, he would have been free to leave the embassy without being arrested on the British warrant.
However, Mr Assange suspects there is a secret US indictment against him for WikiLeaks’ publication of leaked classified American military and diplomatic documents, and that the US authorities will seek his extradition.
